TCT provides our customers the freedom and flexibility to access the Internet and E-mail through our High-Speed, Dial-up, and Wireless Internet (Wifi) services. As a part of our commitment to provide these services, TCT reserves the right to protect our company and customers through an Acceptable Use Policy. Please read the Acceptable Use Policy before you begin to use your TCT Internet or E-mail service .
This Acceptable Use Policy (AAUP) sets forth the principles that govern the use by customers of the systems, services and products provided by tctwest.net and/or tritel.net (Companies). The AUP has been created to promote the integrity, security, reliability and privacy of Companies’ systems and networks.
All services may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State, County or City law is prohibited. This includes, but is not limited to: copyrighted material, material we deem to be threatening, obscene, demeaning to others, or material protected by trade secret and other statute including violations of patent laws or laws protecting other intellectual property including, but not limited to, the installation or distribution of ‘pirated’ or other software products that are not appropriately licensed for use by customer. The subscriber agrees to indemnify and hold Companies harmless from any claims resulting from the use of the service which damages the subscriber or any other party.
Our servers may not be the source, intermediary, or destination address involved in the transmission of spam, flames, or mail bombs. Your domain may not be referenced as originator, intermediary, or reply-to address in any of the above. We consider spam any mass unsolicited messages in the mediums of Newsgroups and E-mail. If you are found to have spammed, we will immediately, without warning, disable your domain and/or Internet account. We reserve the right to refuse or cancel service to known spammers. We reserve the right to determine what violates this policy.
Prohibited Actions:
A. General Conduct
- Transmitting on or through any of the Companies’ systems, services or products any material that is, in companies’ sole discretion, unlawful, obscene, threatening, abusive, libelous, or hateful, or encourages conduct that may constitute a criminal offense, may give rise to civil liability, or otherwise may violate any local, state, national or international law.
- Transmission, distribution, or storage of any information, data or material in violation of federal or state regulations or law, or by the common law.
- Violations of the rights of a person protected by copyright, trade secret, patent or other intellectual property or similar laws or regulations.
- Actions that restrict or inhibit any person, whether a customer of the Companies or otherwise, in its use or enjoyment of any of the Companies’ systems, services or products.
- Resale of Companies’ services and products, without the prior written consent of Companies.
- Deceptive on-line marketing practices.
B. Network and System Security
- Attempting to circumvent user authentication or security of any host, network, or account (Acracking@). This includes, but is not limited to, accessing data not intended for the customer, logging into a server or account the customer is not expressly authorized to access, or probing the security of the networks, including the use of network scan tools.
- Effecting security breaches or disruptions of Internet communications. Security breaches include, but are not limited to, accessing data of which customer is not an intended recipient or logging onto a server or account that customer is not expressly authorized to access. For purposes of this section, ‘disruption’ include, but is not limited to, port scans, ping floods, packet spoofing, forged routing information, deliberate attempts to overload a service, and attempts to ‘crash’ a host.
- Using any program/script/command, or sending messages of any kind, designed to interfere with any user=s terminal session, by any means, locally or by the Internet.
- Executing any form of network monitoring which will intercept data not intended for Customer.
C. E-mail
- Harassment, whether through language, frequency or size of messages, is prohibited.
- Sending unsolicited mail messages, including the sending of ‘junk mail’ or other advertising material to individuals who did not specifically request such material (‘E-mail SPAM’). Customers are explicitly prohibited from sending unsolicited bulk mail messages. This includes, but is not limited to, bulk-mailing of commercial advertising, informational announcements, and political tracts. Such material may only be sent to those who have explicitly requested it. If a recipient asks to stop receiving E-mail, the Customer must not send that person any further E-mail.
- Creating or forwarding ‘chain letters’ or other ‘pyramid schemes’ of any type, whether or not the recipient wishes to receive such mailings.
- Malicious E-mail, including, but not limited to, ‘mail bombing’ (flooding a user or site with very large or numerous pieces of E-mail).
- Unauthorized use, or forging, of mail header information.
- Using Companies’ or a customers’ account to collect replies to messages sent from another provider.
- Use of unsolicited E-mail originating from Companies’ network or networks of other Internet Service Providers (ISP) on behalf of, or to advertise any service hosted by Companies, or connected via the Companies’ network.
- A maximum of 25MB of mail can be stored in individual mailboxes. If an account reaches 20MB, an E-mail will be sent to the user saying that the account is nearing the maximum storage allowed. If the account reaches 25MB, no new mail for that account will be accepted by the server.
D. Usenet Newsgroups
- Posting the same or similar messages to large numbers of Usenet newsgroups (Newsgroups SPAM or USENET SPAM).
- Posting chain letters of any type.
- Posting encoded binary files to newsgroups not specifically named for that purpose.
- Cancellation or superseding of posts other than your own, with the exception of official newsgroups moderators performing their duties.
- Forging the header information. This includes attempting to circumvent the approval process for posting to a moderated newsgroup.
- Solicitations of mail for any other E-mail address other than that of the poster=s account or service, with intent to harass or to collect replies.
- Postings that are in violation of the written charters or FAQ=s for those newsgroups.
- Advertisements posted in newsgroups whose charters or FAQ=s explicitly prohibit them. The poster of an advertisement or other information is responsible for determining the etiquette of a given newsgroup, prior to posting it.
E. Individual Accounts (Dial-up Users)
- Utilizing multiple logins for one access is prohibited.
- Utilizing more than one modem per dial-up account on the Companies’ banks of modems is prohibited.
- Dial-up accounts are intended for interactive use only. The subscriber is prohibited from using any kind of program or utility to maintain a continuous connection. If user needs a 24-hour dedicated connection, this service is available at an extra cost.
- The web space provided with our dial-up accounts (5 Mg) is intended for low-usage sites typically associated with ‘personal’ home pages. Owners of websites that exhibit high resource usage will be asked to terminate the site or move up to a Commercial Account.
- Users are prohibited from using website resources in an inappropriate manner. This includes, but is not limited to: distribution of questionable information, virus code, copyrighted material, obscenity, etc.
- Consuming excessive resources, including memory and disk space is prohibited. The use of resource-intensive programs which negatively impact other system users or the performance of Companies’ systems or networks is prohibited. Companies may take action to limit or terminate such programs.
- Sharing of password and accounts with others is in violation of the Acceptable Use Policy of Companies. Password security is the responsibility of the individual user.
Companies reserve the right to modify this Acceptable Use Policy at any time at its sole and absolute discretion. Changes and modification will be effective when posted and any use of Companies’ network after the posting of such changes will be considered acceptance of those changes.In no event will Companies be liable to any customer or third party for any direct, indirect, special or consequential damages taken pursuant to this AUP, including, but not limited to, any lost profits, business interruption, loss of programs or other data, or otherwise, even if Companies were advised of the possibility of such damages.
Actions listed herein are also not permitted from other ISPs. Deceptive marketing, as defined by the Federal Trade Commission Deception Policy Statement, is not permitted through Companies’ services or network. These rules apply to other types if Internet-based distribution mediums such as FAX-like documents transmitted via Internet.
Companies reserve the right to remove materials from its servers and to terminate Internet access to customers determined by Companies to have violated this AUP.
